Service Provider Identification<\/h2><p data-start=\"626\" data-end=\"712\">The NautiBot AI service is operated by a self-employed individual established in Portugal.<\/p><p data-start=\"714\" data-end=\"723\">Contact:<\/p><p data-start=\"725\" data-end=\"762\">NautiBot AI<br data-start=\"736\" data-end=\"739\" \/>Email: <a class=\"decorated-link cursor-pointer\" rel=\"noopener\" data-start=\"746\" data-end=\"762\">info@nautibot.pt<\/a><\/p><h2 data-start=\"769\" data-end=\"799\" data-section-id=\"19mk9wz\">\u00a0<\/h2><h2 data-start=\"769\" data-end=\"799\" data-section-id=\"19mk9wz\">2. Nature of the Service (B2B)<\/h2><p data-start=\"801\" data-end=\"923\">NautiBot AI is a software and technology integration service (SaaS) intended exclusively for professional use.<\/p><p data-start=\"925\" data-end=\"947\">The service consists of:<\/p><ul><li data-start=\"949\" data-end=\"984\">Creation and initial training of the chatbot<\/li><li data-start=\"986\" data-end=\"1030\">Technical configuration for the Client's website<\/li><li data-start=\"1032\" data-end=\"1080\">Integration with external automation tools<\/li><li data-start=\"1082\" data-end=\"1155\">Configuration of contact capture or pre-booking request flows<\/li><\/ul><p data-start=\"1157\" data-end=\"1268\">The service is intended for tourist operators, boat tour companies or maritime tourism activity providers.<\/p><h1 data-start=\"1275\" data-end=\"1300\" data-section-id=\"1soq5dl\">\u00a0<\/h1><h2 data-start=\"1275\" data-end=\"1300\" data-section-id=\"1soq5dl\">\u00a0<\/h2><h2 data-start=\"1275\" data-end=\"1300\" data-section-id=\"1soq5dl\">3. Trial Period<\/h2><p data-start=\"1302\" data-end=\"1392\">NautiBot may offer a free trial period for demonstration of the tool.<\/p><p data-start=\"1394\" data-end=\"1415\">During this period:<\/p><ul><li data-start=\"1417\" data-end=\"1465\">The system may be tested on the Client's website<\/li><li data-start=\"1467\" data-end=\"1517\">The Client may evaluate the chatbot's performance.<\/li><\/ul><p data-start=\"1519\" data-end=\"1619\">Once the trial period ends, the service may be interrupted if a paid plan is not activated.<\/p><h2 data-start=\"1626\" data-end=\"1649\" data-section-id=\"1c0mnyn\">\u00a0<\/h2><h2 data-start=\"1626\" data-end=\"1649\" data-section-id=\"1c0mnyn\">4. Pricing and Payments<\/h2><p data-start=\"1651\" data-end=\"1712\">Service prices are listed on the website nautibot.pt.<\/p><p data-start=\"1714\" data-end=\"1811\">Payments correspond to the provision of professional services and will be documented through:<\/p><ul><li data-start=\"1813\" data-end=\"1841\">Professional Invoice issued in accordance with Portuguese tax legislation.<\/li><\/ul><h1 data-start=\"1903\" data-end=\"1931\" data-section-id=\"3qzfxb\">\u00a0<\/h1><h2 data-start=\"1903\" data-end=\"1931\" data-section-id=\"3qzfxb\">\u00a0<\/h2><h2 data-start=\"1903\" data-end=\"1931\" data-section-id=\"3qzfxb\">5. Service Cancellation<\/h2><p data-start=\"1933\" data-end=\"1986\">The Client may cancel the service at any time.<\/p><p data-start=\"1988\" data-end=\"2046\">Cancellation takes effect at the end of the already paid period.<\/p><p data-start=\"2048\" data-end=\"2195\">Due to the professional nature of the service and the existence of a trial period, no refunds are provided after the activation of a paid plan.<\/p><h1 data-start=\"2202\" data-end=\"2228\" data-section-id=\"1ud1cw\">\u00a0<\/h1><h2 data-start=\"2202\" data-end=\"2228\" data-section-id=\"1ud1cw\">\u00a0<\/h2><h2 data-start=\"2202\" data-end=\"2228\" data-section-id=\"1ud1cw\">6. Technical Implementation<\/h2><p data-start=\"2230\" data-end=\"2279\">NautiBot installation is carried out remotely.<\/p><p data-start=\"2281\" data-end=\"2396\">To allow implementation, the Client may temporarily provide technical access to their website or platform.<\/p><p data-start=\"2398\" data-end=\"2492\">Upon completion of the installation, the Client must change any shared access credentials.<\/p><p data-start=\"2494\" data-end=\"2600\">NautiBot is not responsible for security incidents resulting from the retention of those credentials.<\/p><h2 data-section-id=\"9jh6im\" data-start=\"2808\" data-end=\"2861\">\u00a0<\/h2><h2 data-section-id=\"9jh6im\" data-start=\"2808\" data-end=\"2861\">6.1 Technical Google Account for System Integration<\/h2><p data-start=\"2863\" data-end=\"3038\">To enable the technical operation of the NautiBot system, it may be necessary to use a Google account (Gmail) associated with the system installed on the Client's website.<\/p><p data-start=\"3040\" data-end=\"3173\">This account may be used exclusively to enable the technical integrations necessary for the operation of the service, including:<\/p><p data-start=\"3175\" data-end=\"3375\">\u2022 Receiving chatbot conversation histories<br data-start=\"3224\" data-end=\"3227\" \/>\u2022 Storing contacts and interactions in Google Sheets<br data-start=\"3285\" data-end=\"3288\" \/>\u2022 Operation of the technical automations connecting the chatbot to the system tools<\/p><p data-start=\"3377\" data-end=\"3462\">These integrations may involve external technology platforms, such as:<\/p><p data-start=\"3464\" data-end=\"3536\">\u2022 Google Sheets<br data-start=\"3479\" data-end=\"3482\" \/>\u2022 Automation systems used by the technical infrastructure of the service<\/p><p data-start=\"3538\" data-end=\"3622\">In accordance with NautiBot's operating model and privacy policy:<\/p><p data-start=\"3624\" data-end=\"3835\">\u2022 Data collected by the chatbot belongs to the website operator<br data-start=\"3691\" data-end=\"3694\" \/>\u2022 NautiBot does not maintain a centralised database of these contacts<br data-start=\"3761\" data-end=\"3764\" \/>\u2022 Collected data must remain under the direct control of the Client<\/p><p data-start=\"3837\" data-end=\"3953\">For this reason, integrations may be configured using a Google account belonging to the Client themselves.<\/p><p data-start=\"3955\" data-end=\"3982\">The Client may choose:<\/p><p data-start=\"3984\" data-end=\"4078\"><strong>Option 1 (recommended)<\/strong><br data-start=\"4009\" data-end=\"4012\" \/>Create a Gmail account dedicated exclusively to the NautiBot system.<\/p><p data-start=\"4080\" data-end=\"4192\"><strong>Option 2<\/strong><br data-start=\"4091\" data-end=\"4094\" \/>Temporarily provide access to an existing Google account for technical configuration purposes<\/p><p data-start=\"4194\" data-end=\"4335\">If temporary access is required for installation or initial configuration, the Client may provide temporary credentials to NautiBot.<\/p><p data-start=\"4337\" data-end=\"4394\">Upon completion of the system installation and configuration:<\/p><p data-start=\"4396\" data-end=\"4575\">\u2022 The Client may change the account password<br data-start=\"4442\" data-end=\"4445\" \/>\u2022 NautiBot will no longer have access to the account<br data-start=\"4487\" data-end=\"4490\" \/>\u2022 All data generated by the chatbot will remain under the exclusive control of the Client.<\/p><p data-start=\"4577\" data-end=\"4777\">This procedure aims to ensure operational transparency and compliance with the General Data Protection Regulation (GDPR), in alignment with the remaining legal documentation of the NautiBot service.<\/p><h2 data-start=\"2607\" data-end=\"2649\" data-section-id=\"10db0ct\">\u00a0<\/h2><h2 data-start=\"2607\" data-end=\"2649\" data-section-id=\"10db0ct\">7. Third-Party Technology Tools<\/h2><p data-start=\"2651\" data-end=\"2741\">The operation of NautiBot may depend on the use of external technology services.<\/p><p data-start=\"2743\" data-end=\"2777\">These may include, among others:<\/p><ul><li data-start=\"2779\" data-end=\"2801\">Chatbot platforms<\/li><li data-start=\"2803\" data-end=\"2824\">Automation systems<\/li><li data-start=\"2826\" data-end=\"2840\">Cloud Services<\/li><li data-start=\"2842\" data-end=\"2877\">Sistemas de armazenamento de dados<\/li><\/ul><p data-start=\"2879\" data-end=\"2978\">These services are operated by independent entities and subject to their own legal terms.<\/p><p data-start=\"2980\" data-end=\"3034\">NautiBot does not directly control these platforms.<\/p><h1 data-start=\"3041\" data-end=\"3088\" data-section-id=\"5gdo3w\">\u00a0<\/h1><h2 data-start=\"3041\" data-end=\"3088\" data-section-id=\"5gdo3w\">\u00a0<\/h2><h2 data-start=\"3041\" data-end=\"3088\" data-section-id=\"5gdo3w\">8. Data Responsibility Structure<\/h2><p data-start=\"3090\" data-end=\"3171\">The processing of personal data in the context of the service is described in the document:<\/p><p data-start=\"3173\" data-end=\"3226\">Data Processing &amp; Service Integration Agreement (DPA)<\/p><p data-start=\"3228\" data-end=\"3246\">In summary:<\/p><p data-start=\"3248\" data-end=\"3311\">Data collected on nautibot.pt<br data-start=\"3279\" data-end=\"3282\" \/>NautiBot's responsibility.<\/p><p data-start=\"3313\" data-end=\"3413\">Data collected on the Client's website<br data-start=\"3351\" data-end=\"3354\" \/>Sole responsibility of the Client (tourist operator).<\/p><p data-start=\"3415\" data-end=\"3545\">NautiBot does not access or store personal data collected through the chatbot installed on the Client's website (tourist operator).<\/p><h2 data-start=\"3552\" data-end=\"3624\" data-section-id=\"yp3pbb\">\u00a0<\/h2><h2 data-start=\"3552\" data-end=\"3624\" data-section-id=\"yp3pbb\">9. Intellectual Property, Technical Infrastructure and System Management<\/h2><h2 data-start=\"3626\" data-end=\"3656\" data-section-id=\"1tw8a5w\">9.1 Intellectual Property<\/h2><p data-start=\"3658\" data-end=\"3882\">All software, methodology, automation architecture, integration logic, technical flows, configurations and operational structure associated with the NautiBot AI service constitute the exclusive intellectual property of NautiBot.<\/p><p data-start=\"3884\" data-end=\"4020\">The Client receives only a limited, personal and non-transferable licence to use the service, valid for the duration of the contract.<\/p><p data-start=\"4022\" data-end=\"4095\">This licence does not confer any ownership rights over the system.<\/p><h2 data-start=\"4102\" data-end=\"4144\" data-section-id=\"dpuzw2\">\u00a0<\/h2><h2 data-start=\"4102\" data-end=\"4144\" data-section-id=\"dpuzw2\">9.2 Proprietary Technical Infrastructure<\/h2><p data-start=\"4146\" data-end=\"4254\">The operation of NautiBot may depend on technical integrations between different technology platforms.<\/p><p data-start=\"4256\" data-end=\"4482\">The configuration of these integrations, including the connection between chatbot tools, automation and data processing, constitutes proprietary technical infrastructure of NautiBot and a professional trade secret of the service provider.<\/p><p data-start=\"4484\" data-end=\"4609\">These configurations are created and managed exclusively by NautiBot and are not made available to the Client or to third parties.<\/p><h2 data-start=\"4616\" data-end=\"4646\" data-section-id=\"905gdo\">\u00a0<\/h2><h2 data-start=\"4616\" data-end=\"4646\" data-section-id=\"905gdo\">9.3 Restricted Technical Access<\/h2><p data-start=\"4648\" data-end=\"4784\">The Client acknowledges that access to the accounts and technical configurations used for the operation of NautiBot is exclusive to NautiBot.<\/p><p data-start=\"4786\" data-end=\"4803\">Consequently:<\/p><ul><li data-start=\"4805\" data-end=\"4883\">Third parties may not access the technical accounts used to operate the system<\/li><li data-start=\"4885\" data-end=\"4949\">Third parties may not modify the technical integrations of the service<\/li><li data-start=\"4951\" data-end=\"5027\">Third parties may not analyse or reproduce the technical architecture of the system.<\/li><\/ul><p data-start=\"5029\" data-end=\"5140\">This restriction applies only to the integrations and systems that form part of the internal operation of NautiBot.<\/p><p data-start=\"5142\" data-end=\"5272\">The Client retains full freedom to work with third parties on any other element of their website or digital infrastructure<\/p><h2 data-start=\"5279\" data-end=\"5318\" data-section-id=\"1eayne4\">\u00a0<\/h2><h2 data-start=\"5279\" data-end=\"5318\" data-section-id=\"1eayne4\">9.4 Installation on the Client's Website<\/h2><p data-start=\"5320\" data-end=\"5478\">For the purpose of operating the system, NautiBot provides the Client with a code or technical widget that must be integrated into the tourist operator's website.<\/p><p data-start=\"5480\" data-end=\"5580\">This code enables communication between the Client's website and NautiBot's technical infrastructure.<\/p><p data-start=\"5582\" data-end=\"5666\">The Client does not receive access to the internal integrations that support this operation<\/p><p data-start=\"5668\" data-end=\"5844\">NautiBot reserves the right to manage and update this technical code whenever necessary to ensure the operation, security, improvement or scalability of the service.<\/p><p data-start=\"5846\" data-end=\"6023\">Whenever necessary, NautiBot may contact the Client to request the update, replacement or reinstallation of the code on the tourist operator's website.<\/p><p data-start=\"6025\" data-end=\"6188\">If the Client does not respond or does not carry out the requested update within a reasonable timeframe, NautiBot cannot guarantee the correct operation of the system.<\/p><p data-start=\"6190\" data-end=\"6362\">Any interruptions, operational limitations or failures resulting from the failure to update the code requested by NautiBot shall not constitute NautiBot's responsibility.<\/p><p data-start=\"6364\" data-end=\"6548\">The technical management of this code is part of the service operation, and NautiBot may request changes whenever necessary for the evolution of the product or technical infrastructure.<\/p><h2 data-start=\"6555\" data-end=\"6589\" data-section-id=\"9k18l8\">\u00a0<\/h2><h2 data-start=\"6555\" data-end=\"6589\" data-section-id=\"9k18l8\">9.5 Client Data Managemen<\/h2><p data-start=\"6591\" data-end=\"6730\">Personal data collected through the chatbot is sent directly to storage infrastructures configured for the Client.<\/p><p data-start=\"6732\" data-end=\"6745\">Namely:<\/p><ul><li data-start=\"6747\" data-end=\"6764\">operator's email<\/li><li data-start=\"6766\" data-end=\"6822\">Spreadsheet (Google Sheet) controlled by the Client.<\/li><\/ul><p data-start=\"6824\" data-end=\"6907\">The Client has full and exclusive access to this database and is responsible for its management.<\/p><h2 data-start=\"6914\" data-end=\"6947\" data-section-id=\"16udo3q\">\u00a0<\/h2><h2 data-start=\"6914\" data-end=\"6947\" data-section-id=\"16udo3q\">9.6 Altera\u00e7\u00f5es \u00e0 Base de Dados<\/h2><p data-start=\"6949\" data-end=\"7147\">Caso o Cliente altere manualmente a estrutura da base de dados, campos, integra\u00e7\u00f5es ou automa\u00e7\u00f5es que suportam o funcionamento do sistema, poder\u00e1 ocorrer interrup\u00e7\u00e3o ou mau funcionamento do servi\u00e7o.<\/p><p data-start=\"7149\" data-end=\"7162\">In these cases:<\/p><ul><li data-start=\"7164\" data-end=\"7227\">Responsibility for the changes lies solely with the Client<\/li><li data-start=\"7229\" data-end=\"7406\">Restoring the original configuration may incur an additional technical reconfiguration fee, in accordance with the time required to re-establish the system's operation.<\/li><\/ul><h2 data-start=\"7413\" data-end=\"7450\" data-section-id=\"p1pudy\">\u00a0<\/h2><h2 data-start=\"7413\" data-end=\"7450\" data-section-id=\"p1pudy\">9.7 Prote\u00e7\u00e3o do Modelo Operacional<\/h2><p data-start=\"7452\" data-end=\"7551\">O Cliente compromete-se a n\u00e3o utilizar o conhecimento obtido atrav\u00e9s da utiliza\u00e7\u00e3o do servi\u00e7o para:<\/p><ul><li data-start=\"7553\" data-end=\"7582\">Reproduzir o sistema NautiBot<\/li><li data-start=\"7584\" data-end=\"7626\">Desenvolver solu\u00e7\u00f5es t\u00e9cnicas equivalentes<\/li><li data-start=\"7628\" data-end=\"7706\">Permitir que terceiros analisem ou repliquem a arquitetura t\u00e9cnica do servi\u00e7o.<\/li><\/ul><h1 data-start=\"7713\" data-end=\"7756\" data-section-id=\"va9xt9\">\u00a0<\/h1><h2 data-start=\"7413\" data-end=\"7450\" data-section-id=\"p1pudy\">\u00a0<\/h2><h2 data-start=\"7413\" data-end=\"7450\" data-section-id=\"p1pudy\">9.8 Identifica\u00e7\u00e3o do Servi\u00e7o (Branding)<\/h2><p data-start=\"7713\" data-end=\"7756\" data-section-id=\"va9xt9\">O chatbot disponibilizado pela NautiBot inclui, por defeito, uma refer\u00eancia visual e\/ou textual ao servi\u00e7o (&#8220;Powered by NautiBot AI&#8221; ou similar). Esta men\u00e7\u00e3o \u00e9 parte integrante da identidade do produto e n\u00e3o deve ser removida ou ocultada pelo Cliente.<\/p><h2 data-start=\"7413\" data-end=\"7450\" data-section-id=\"p1pudy\">\u00a0<\/h2><h2 data-start=\"7413\" data-end=\"7450\" data-section-id=\"p1pudy\">9.9 Op\u00e7\u00e3o de Remo\u00e7\u00e3o de Marca (White Label)<\/h2><p data-path-to-node=\"5\">Caso o Cliente pretenda utilizar o sistema sem qualquer refer\u00eancia visual \u00e0 NautiBot AI (modalidade <i data-path-to-node=\"5\" data-index-in-node=\"144\">White Label<\/i>), aplicar-se-\u00e3o as seguintes condi\u00e7\u00f5es:<\/p><ul data-path-to-node=\"6\"><li><p data-path-to-node=\"6,0,0\">Custo Adicional: A remo\u00e7\u00e3o da marca implica o pagamento de uma taxa adicional correspondente ao dobro (100% de acr\u00e9scimo) do valor anual do plano subscrito.<\/p><\/li><li><p data-path-to-node=\"6,1,0\">Periodicidade: Uma vez que o servi\u00e7o \u00e9 renovado anualmente, a taxa de remo\u00e7\u00e3o de marca \u00e9 igualmente anual, devendo ser liquidada no momento da renova\u00e7\u00e3o do servi\u00e7o para que a omiss\u00e3o da marca se mantenha ativa.<\/p><\/li><li><p data-path-to-node=\"6,2,0\">Acordos Excecionais: Qualquer altera\u00e7\u00e3o a estas condi\u00e7\u00f5es ou remo\u00e7\u00e3o da marca sem o pagamento da taxa referida carece de um acordo escrito e assinado por ambas as partes.<\/p><\/li><\/ul><h2 data-start=\"7713\" data-end=\"7756\" data-section-id=\"va9xt9\">\u00a0<\/h2><h2 data-start=\"7713\" data-end=\"7756\" data-section-id=\"va9xt9\">10. Depend\u00eancia de Infraestrutura Externa<\/h2><p data-start=\"7758\" data-end=\"7802\">O funcionamento do sistema pode depender de:<\/p><ul><li data-start=\"7804\" data-end=\"7818\">cloud services<\/li><li data-start=\"7820\" data-end=\"7833\">APIs externas<\/li><li data-start=\"7835\" data-end=\"7859\">plataformas de automa\u00e7\u00e3o<\/li><li data-start=\"7861\" data-end=\"7886\">ferramentas de terceiros.<\/li><\/ul><p data-start=\"7888\" data-end=\"7961\">A NautiBot n\u00e3o garante a disponibilidade cont\u00ednua dessas infraestruturas.<\/p><p data-start=\"7963\" data-end=\"8047\">Interrup\u00e7\u00f5es causadas por servi\u00e7os externos n\u00e3o constituem incumprimento contratual.<\/p><h1 data-start=\"8054\" data-end=\"8082\" data-section-id=\"yveqda\">\u00a0<\/h1><h2 data-start=\"8054\" data-end=\"8082\" data-section-id=\"yveqda\">\u00a0<\/h2><h2 data-start=\"8054\" data-end=\"8082\" data-section-id=\"yveqda\">11.
